UPDATE: August 19 at 5:43 p.m.Through court record investigations, LEX News discovered this isn't Cody Casey's first run-in with trouble, as there are old cases connected to Casey dating back as early as 2010.According to court records, Casey has had 15 traffic violations:Mercer County - 10Anderson County - 3Jessamine County - 1Washington County 1According to a Jessamine County citation from September 2024, police charged Casey with reckless driving after they say he almost hit an off-duty Lexington Police officers on US-68, and they say he had alcohol present.LEX News has also discovered through court documents both a theft and a repeat felony offender charge in Russell County from 2014 were dismissed.Attorney Justin Peterson with Peterson Law Office, who represents the Svintozelskaya family, released this statement on behalf of the family: The family appreciates, first off, all of the well-wishes from the public, the public outcry for justice, and they appreciate law enforcement's effort to move the criminal case forward. They're grateful it's moving forward on a path toward justice."According to Peterson, Aleksander Svintolzelskiy suffered a profound traumatic brain injury, blindness in both eyes, inability to walk, chest fracture, facial bone fracture, a subdural hematoma, C4 fracture, cervical fracture, respiratory failure, and much more.Peterson says they are seeking both punitive damages and the harms and losses someone suffers from this kind of incident. He also plans to go for the maximum sentence.He leaves everyone with one last message from the family: The family's so thankful for the outpouring of love and support and that they know the authorities and their attorneys are gonna work tire tirelessly until justice prevails.Casey is scheduled to be back in court on September 21.Original Story:A man from Mercer County has been arrested in connection with a deadly boat crash on July 4 at Herrington Lake.A Mercer County grand jury indicted Cody Casey on 19 charges, according to a court document released to LEX18 on Tuesday. Those charges include second-degree manslaughter, first-degree assault, first-degree wanton endangerment, and multiple allegations related to leaving the scene and failing to render aid.Casey was arrested by Kentucky Fish and Wildlife on Tuesday evening, according to the Boyle County Detention Center.The arrest follows a lawsuit filed on Monday against Casey. According to documents filed in Mercer County Circuit Court, the attorneys representing Antonina Svintozelskaya and Andrew and Lina Fomin have filed the lawsuit on behalf of the families and multiple children involved in the collision.The lawsuit alleges that on July 4, the Svintozelskaya and Fomin families were stationary in a pontoon boat on Herrington Lake at the time of the collision.The suit goes on to argue that Cody Casey, a Mercer County resident, was driving a 2017 Axis watercraft leading up to the time of the collision, driving "in a reckless and dangerous manner by driving at an excessive rate of speed, performing repeated 'donuts' and other erratic maneuvers in close proximity to boaters on a crowded Herrington Lake during a busy holiday weekend."Casey's boat then allegedly struck the pontoon boat head-on, "causing catastrophic damage to the pontoon boat and violently impacting and throwing its occupants about the watercraft and into the water."He then fled the scene of the collision without rendering aid, the suit alleges.The lawsuit is seeking counts of negligence, gross negligence, failure to render aid, and punitive damages. It is not seeking damages in connection to the death of 25-year-old Nazar Svintozelskiy.With the grand jury indictment, Casey faces a second-degree manslaughter charge in the death of Nazar Svintolzelskiy, whom he struck with a boat, according to court documents. He was charged with first-degree assault for seriously injuring Aleksander Svintolzelskiy and fourth-degree assault for injuring Antonina Svintozelskaya, both of which court documents say he also struck with a boat.Casey faces 11 counts of first-degree wanton endangerment in relation to various people, in addition to charges related to failure to render aid, failure to report the crash as well as tampering with evidence and evading police.Casey's bond is listed at $1 million cash, with the following conditions: he is to have no contact with the alleged victims or their family, not to operate a vehicle of any kind, not allowed to use alcohol or drugs, must attend all scheduled court appearances and not be arrested again.After initially being held in the Boyle County Detention Center, LEX News has learned he has since been moved to Woodford County. ...read more read less
