LEBANON, Ind. (WRTV) -- The Boone County prosecutor wants to move an arson case involving an 18-year-old man from juvenile to adult court following a fire that happened in July on historic Main Street.The Boone County Prosecutor s Office filed a juvenile delinquency petition Monday against the man for an arson that happened at 1:41 a.m. July 10 at 195 S. Main St., the former Kogan Antiques and Lighting. While the suspect is now 18, he was 17 when the fire happened. Authorities have not yet publicly named the suspect.Zionsville Police Department said in a news release that the teen was arrested at 3:50 p.m. Monday.The blaze caused more than $150,000 in damage. Zionsville Mayor John Stehr said July 10 that surveillance footage and burn patterns suggest the fire started when someone lit an Israeli flag that had been hanging outside the building for three years.The Republican mayor on July 10 called the attack appalling and abhorrent, noting that the incident does not define the town.Because the suspect was a minor at the time of the fire, Indiana law requires the case to start in juvenile court. However, Prosecuting Attorney Kent Eastwood said in a note with a news release issued Monday night that his office wants to move the case to adult court so it can proceed in the adult criminal justice system. A judge will hold a hearing on that request at a later date.Under Indiana law, juvenile court records and hearings are typically confidential. However, state law allows public access to certain records, such as the persons name and age, when a petition alleges an act that would be a felony if committed by an adult. Most hearings in this case will also be open to the public unless a judge orders otherwise.Eastwood noted that the delinquency petition is only an allegation until proven in court.The Zionsville Police Department was leading the investigation.
