Carlsbad security guard faces felony charges after bar tasing incident

A security guard has pleaded not guilty to three felony charges after prosecutors say he tased a 21-year-old bar patron in the face outside Park 101 in Carlsbad.

The incident happened on Wednesday, June 24 outside Park 101, a popular gathering spot where people had been watching FIFA World Cup matches.
According to Deputy District Attorney Kimberly Coulter, 21-year-old Roberto Pulito had been celebrating a FIFA win and had been drinking before he was asked to leave the bar. Coulter said Pulito was outside the bar’s perimeter on the sidewalk, speaking with Marquez from a little more than an arm’s length away when the encounter escalated.
A video circulating on social media appears to show Marquez raising his arm, holding a Taser at Pulito’s eye level and firing, sending the probes into Pulito’s face.
“The victim was really lucky in this case. The probes from the stun gun hit him at the very corner of the inside of his left eye and about a centimeter or so below the middle of his left eye. At this time, there is evidence that there has been substantial injury, [but] should there have been, we would have been asking for remand and no bail,” Coulter said.
Carlsbad police said officers arrived before 8:30 p.m. that night and arrested Marquez on suspicion of assault with a deadly weapon and assault with a stun gun. Those are two of the charges he now formally faces.
Two men who were at the bar before the incident described a crowded atmosphere during the World Cup festivities.
“For the Mexico game … I’ve never seen so many people here,” one man said.
Coulter also said the District Attorney’s Office found another social media video that appears to show Marquez involved in a physical fight with a patron before the Taser incident. When asked whether it was recorded the same day, Coulter said prosecutors assume it was because of other details visible in the video, including the time of day.
Authorities have not said what led to the confrontation between Marquez and Pulito other than that Pulito had been drinking and was asked to leave the bar.
Court records discussed during the hearing showed Marquez has a 2006 misdemeanor case for domestic violence. Prosecutors said that case involved allegations that he held his fiancée by the throat and prevented her from calling 911.
Park 101 declined to comment on this incident. Marquez and his defense attorney, Thomas Moller, also declined to provide a statement.
Marquez is scheduled to return to court next month.
