Maryland becomes first state to ban dynamic pricing in grocery stores
Apr 29, 2026
Another marathon round of bill signings from this year’s legislative session came and went on Tuesday, making Maryland the first state to ban dynamic pricing in grocery stores.
The Protection from Predatory Pricing Act was one of the first legislative priorities announced by the Moore
administration this year and received the immediate backing of Senate President Bill Ferguson (D-Baltimore City) and House Speaker Joseline Peña-Melnyk (D-Anne Arundel and Prince George’s Counties).
The bill will ban food retailers, including third-party delivery services like Instacart, from using dynamic and surveillance pricing, a cost-setting method where prices are inflated based on time of day, weather conditions and personal data.
