New video from a witness has emerged showing an ICE shooting on a Central Valley road this week, and it’s raising questions about the agent’s version of what happened. The agency had said they were stopping a wanted gang member in connection with a murder investigation and opened fire after h e tried to hit them with his car. But a witness, and her video suggest the man may have been trying to escape because an ICE agent started firing. This witness wanted to go by the name Christina. She shared dash cam footage from the morning of April 7 in Patterson. Christina said she was on her way to work when she came upon what she thought was a traffic stop. “I thought maybe someone was getting arrested because I saw two people, one in front of the other from a bit further away and once it gets closer, I notice the officers are pushing on the front of the car,” she said. She and her attorney held a press conference to offer her account of what happened. ICE has said the agents fired because the driver tried to hit the agents, but Christina said she thinks the ICE agents fired first. The video doesn’t offer a clear view to support either side and did not capture any sound. Christina says she is cooperating with the investigation as the FBI tries to figure out what happened. The man ICE shot, Carlos Ivan Mendoza Hernandez is said to remain in critical condition. His attorney said he was shot six or seven times and reiterated that he believes the man only tried to drive away because agents started shooting. “Carlos made it clear. I think I said that in my last press conference he did not move until he was hit by a bullet and he was just backing up to get out of there because he was afraid for his life,” Attorney Patrick Kolasinski said. NBC Bay Area asked for comment on the new video, but the Department of Homeland Security resent an earlier statement, saying the agents made a targeted stop of a gang member wanted in connection with an El Salvador murder, adding: “As officers approached the car, the wanted gang members weaponized his vehicle in a attempt to run an officer over. Following their training, our officers fired defensive shots to protect themselves, their fellow agents, and the public.” However, Christina said, from her vantage point, officers fired before Mendoza Hernandez tried to leave. She also said she was scared others would be hit by the agent’s gunfire. “Around this time, the officer what looked like to me was pointing his firearm in the direction of all of the traffic that was there and I was just like really in shock the whole time,” she said. ...read more read less
