A Fallbrook man charged with shooting two men and killing one of them faced a judge on Thursday. The shooting happened on East Mission Road at around 8 p.m. Monday night, according to the San Diego County Sheriff’s Office. When deputies responded to the report of assault with a deadly weapon , they found two men suffering traumatic injuries. Family identified the victim as Martin Lucas. “My dad was leaving from work,” said Lucas’ daughter, Martina. “My dad was on private property because he knew the owner of the house.” Lucas and his coworker, who Martina wasn’t comfortable naming, were leaving their landscaper jobs for the day. She said they were sitting in their truck on Monday night, while 70-year-old Michael Burke stood beside it holding a gun. In a video posted to social media, Burke asks the men if they know Spanish and if they “want to die today.” “Do you want to die today? I will kill you right now,” he repeated before pointing a shotgun in the truck and firing. Lucas was driving, and Martina said he lost control and that the truck rolled down a hill, crashing into bushes. He died at the scene. “That guy had no heart killing him,” Martina said as she sat beside her mother and three brothers before Burke’s first court hearing. “If we get to say anything to his face, I would tell him that I hope he dies in there, that why did he kill my father? My father didn’t deserve to die.” Burke pleaded not guilty to murder, attempted murder and shooting into an occupied vehicle. He will be back in court on March 27.
