Fix it or we’ll sue. That’s the message from animal advocates who say they’ll head to court if San Jose’s animal shelter doesn’t address ongoing accusations of animal neglect. The city says it is making improvements at the San Jose Animal Care Center, but attorneys representing an anima l rescue group say the city is violating state civil code and some animals have died. For the past several years, advocates say they have complained to the city about neglect and other issues at the shelter, including animals left without food and water and a lack of staff training. “No matter the concern, we get back initially deflection, denial, dismissal, delays,” Partners in Animal Care and Compassion founder Kit O’Doherty said. “There have been several tactics to delay improvements of the shelter.” O’Doherty said attorneys representing her nonprofit rescue group have sent a demand letter to the city warning they will pursue legal action if the city fails to adequately address deficiencies outlined in a 2024 city audit. In a statement, City Attorney Susana Alcala Wood said, “The City remains actively focused on meeting the needs of the animal shelter and providing the highest level of humane care possible. Our most recent annual report reflects meaningful improvements in animal care and conditions. While progress takes time, the health, safety, and well-being of animals in our care remains our foremost priority.” California civil code requires the shelter to provide necessary veterinary care, adequate nutrition, water and shelter. Advocates say that’s still not happening. The group’s warning letter also claims they have evidence of routine surgeries resulting in suffocation of animals. “They are not even meeting the basics in being able to adequately care for, feed, clean and provide medical attention to the animals,” O’Doherty said. The group said pursuing legal action is a last resort, but advocates also say they’re tired of waiting for the shelter to make necessary changes.
