LANSING, MI. (WOWO) Michigan House Republicans are moving to repeal the state’s red flag gun law, arguing the statute violates due process protections and Second Amendment rights. Legislation introduced by Representative Jim DeSana of Carleton would eliminate Michigan’s extreme risk protection o rder law, which allows courts to temporarily remove firearms from individuals believed to pose a danger to themselves or others. The bill is backed by 25 Republican lawmakers and was debated Wednesday in the House Judiciary Committee. The law was enacted in 2023 and took effect in early 2024 as part of a package of gun safety measures signed by Governor Gretchen Whitmer. It allows law enforcement, family members, and others to petition courts for an order requiring firearms to be surrendered for up to one year, with hearings required to continue or rescind the order. Supporters of repeal argue the law unfairly targets lawful gun owners and presumes guilt before due process is completed. DeSana said Michigan already has other criminal and mental health laws that can address threats without firearm removal orders. Opponents of repeal, including law enforcement officials, testified that the law has been used as intended. Southfield Police Deputy Chief Aaron Huguley told lawmakers the orders provide officers with a tool to address dangerous situations before violence occurs. State data show 391 extreme risk protection orders were requested in Michigan between February and December 2024. Judges approved 287 of those requests, denied 84, and rescinded eight following hearings. At least 31 individuals subject to the orders were charged with crimes within one month of a petition being filed. Democratic lawmakers defending the law said its use mirrors outcomes in other states with similar statutes. They argued the process includes judicial oversight and opportunities for firearm owners to challenge orders. No vote was taken on the repeal legislation. Even if passed by the Republican-led House, the proposal is unlikely to advance in the Democratic-controlled Senate or be signed by Governor Whitmer.
