RICHMOND, Va. (WRIC) — Virginia is one of nearly two dozen states suing Uber for alleged deceptive and unfair practices. The Virginia Office of the Attorney General announced on Monday, Dec. 15, that it has joined a lawsuit previously filed by the Federal Trade Commission against Uber Technologie s LLC and Uber USA LLC. A coalition of 21 other state law enforcement agencies, including the attorneys general of Pennsylvania, New York, Ohio, Missouri and the District of Columbia, has also joined the suit. According to the lawsuit, Uber uses a variety of "deceptive and unfair practices" regarding its Uber One subscription services. The company allegedly misled consumers about the amount of money they could save on rides and deliveries through an Uber One membership and made it "extraordinarily difficult" to cancel the service once consumers are enrolled. "Internal Uber One testing shows that 85% of consumers who were beingcharged for Uber One and wanted to cancel it would not keep it even if it only cost $1," the complaint against Uber stated. The lawsuit also accused Uber of using negative option marketing tactics when offering its free trial subscriptions, meaning the company automatically charges consumers if they don't cancel the free trial. Per the lawsuit, some consumers -- including those whose free trial has not yet ended -- said they have been charged before their billing date. Consumers looking to cancel their subscription within 48 hours of the billing date have to "take as many as 32 actions and navigate as many as 23 screens" and contact customer service, as Uber has allegedly removed the cancellation option from the app during this period, per the complaint. The joint lawsuit seeks restitution, penalties, costs and an injunction against Uber for allegedly violating the U.S. Restore Online Shoppers' Confidence Act and certain state consumer protection laws, according to the release. The act broadly protects consumers from deceptive billing practices and requires companies to offer simple cancellation mechanisms.
